Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between you and AJAX Digital Solutions LLC governing your access to and use of the StreamTag website, browser extension, Windows companion application, licensing service, and related support (collectively, the "Service"). By creating an account, installing StreamTag, starting a subscription, or using the Service, you agree to these Terms and our Privacy Policy. If you use StreamTag for a business, you represent that you have authority to bind that business.

2. Eligibility and accounts

You must be legally capable of entering this agreement and provide accurate account information. You are responsible for safeguarding your password, devices, and account access and for activity performed through your account. Notify us promptly through support if you believe your account has been compromised.

3. License and permitted use

Subject to these Terms and an active StreamTag account, we give you a limited, non-exclusive, non-transferable, revocable license to install and use StreamTag's free features for your own lawful live-commerce workflow. Paid features require an active trial, subscription, or authorized access grant. StreamTag may limit the number of activated devices associated with an account.

You may not:

• Sell, sublicense, rent, share, or transfer account access or license credentials.
• Circumvent licensing, access controls, update requirements, device limits, or security protections.
• Use the Service to violate law, marketplace rules, intellectual-property rights, privacy rights, or another person's rights.
• Interfere with, overload, damage, or probe the Service or use automated means to abuse it.
• Copy, modify, distribute, or create derivative works from StreamTag except where applicable law expressly permits an activity that cannot lawfully be restricted.

4. Trials, subscriptions, and payment

StreamTag currently provides label printing and buyers.txt on the free plan. Sale screenshots and detailed show logs require Pro access. StreamTag may offer a trial or promotional access. Unless otherwise stated, paid subscriptions renew automatically each billing period until canceled. Prices, billing frequency, and applicable taxes are shown before purchase. Payments are processed by Stripe under Stripe's terms.

You may cancel through the StreamTag billing portal. Cancellation stops future renewals and normally takes effect at the end of the current paid period. Except where required by law or expressly stated otherwise at purchase, fees already paid are not refundable or prorated. If a payment fails, access may be limited or suspended.

5. Access codes and referrals

Access codes, trial extensions, referral links, and promotional rewards may have separate eligibility, expiration, redemption, and usage limits. They have no cash value, may not be sold or transferred, and may be revoked for fraud, abuse, error, or violation of these Terms. Referral rewards are subject to the terms shown with the program and may be delayed to account for reversals, refunds, or disputes.

6. Your responsibilities

You control when StreamTag is active, which seller or show it monitors, whether screenshots are enabled, and which printer Windows treats as the default. You are responsible for checking labels and records before relying on them, protecting locally saved show files, obtaining any notices or permissions required for screenshots or other records, and complying with the rules of every marketplace you use.

7. Third-party services

StreamTag interoperates with browsers, Windows, printers, payment providers, and third-party marketplaces. Those services are governed by their own terms and may change without notice. StreamTag is not affiliated with, endorsed by, or sponsored by Whatnot or any other marketplace. We do not control third-party services and are not responsible for their availability, content, policies, or changes.

8. Updates and service changes

We may release updates, require a supported version, add or remove features, or modify the Service to address compatibility, security, legal, or operational needs. Some updates may be installed automatically with your permission or may be required before printing, screenshots, or other features continue. We may suspend the Service temporarily for maintenance or emergencies.

9. Ownership and feedback

StreamTag, its software, branding, website, and related materials are owned by AJAX Digital Solutions LLC or its licensors and are protected by applicable intellectual-property laws. You retain rights in information you provide. If you send suggestions or feedback, you allow us to use them without restriction or compensation.

10. Suspension and termination

You may stop using StreamTag at any time and may request account closure through support. We may suspend or terminate access when reasonably necessary for nonpayment, fraud, abuse, security risk, legal compliance, marketplace harm, or a material violation of these Terms. Termination ends your license, but provisions that by their nature should survive—including payment obligations, ownership, disclaimers, limitations, and dispute terms—remain effective.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. StreamTag is a sorting aid, not a shipping, accounting, tax, inventory, or marketplace system of record. You remain responsible for verifying buyers, items, labels, records, payments, shipments, and compliance obligations.

12. Limitation of liability

To the fullest extent permitted by law, AJAX Digital Solutions LLC and its members, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, sales, or business interruption arising from or related to StreamTag. Our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid for StreamTag during the six months before the event giving rise to the claim or fifty U.S. dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless AJAX Digital Solutions LLC from third-party claims, damages, and reasonable costs arising from your unlawful use of StreamTag, your violation of these Terms, or your infringement of another person's rights.

14. Governing law

These Terms are governed by the laws of the state in which AJAX Digital Solutions LLC is organized, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in a court of competent jurisdiction located in that state, unless applicable consumer law requires otherwise.

15. General terms

These Terms and the Privacy Policy are the entire agreement concerning the Service unless additional written terms apply. If any provision is unenforceable, the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer.

16. Changes and contact

We may update these Terms by posting a revised version and changing the effective date. If a change is material, we may provide additional notice. Continued use after the effective date means you accept the revised Terms.
